- Unintentional tort is one which is negligent, while an intentional tort is one which is done deliberately. Intentional tort is done with intention of inflicting injury or harm on the other person or property. These includes assault, private nuisance etc. Unintentional tort are which the negligent act could be accidental or attributed to thoughtlessness.
Explanation:
Negligence is when a person falls below the reasonable, acceptable standard of care for protecting those around them. In unintentional torts, the defendant did not intend to harm the plaintiff with their actions, but they are still held responsible because of their carelessness at the time they caused injury. Unintentional tort is based on duty of care by the defendant, and breach of which caused the injury. Intentional torts on the other hand, stem from purposeful acts which result to injury. Example of intentional tort is defamation or harmful contact with another person.
